1.1
To all orders agreements of Triotrabant.nl apply to the exclusion of any other general conditions these General Terms and Conditions of Sale (hereinafter: Conditions).

1.2
Making an order constitutes your acceptance of the applicability of these Terms and Conditions.

1.3
The provisions of these Conditions may be departed from only in writing, in which case the remaining provisions shall remain in full force and effect.

1.4
All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for the benefit of Triotrabant. nl, are equally stipulated for the benefit of intermediaries and other third parties engaged by Triotrabant.nl.

2.1
All products of Triotrabant.nl are without engagement and only valid for purchases placed through the website. Triotrabant.nl expressly reserves the right to change prices & VAT rates, in particular when that is necessary on the basis of (legal) regulations.

2.2
An agreement comes into effect only after acceptance of your order by Triotrabant.nl.

Triotrabant.nl is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Triotrabant.nl will notify you within two (2) business days after receipt of the order.

3.1
The prices listed for the products offered are valid only for purchases placed through the website. Prices are in euros and include VAT.

3.2
Shipping costs on Triotrabant.nl are determined by the amount of the order amount i.c.m. the destination of the order. One can at no time derive rights from the automatically calculated shipping costs. Triotrabant.nl expressly reserves the right to change the shipping rates.

If a change occurs, you are entitled to cancel the order or terminate the agreement within seven (7) days after notification of the increase in shipping costs by Triotrabant.nl.

3.3
Payment may be made by any of the methods indicated during the ordering process.

3.4
If you are in default with any payment, Triotrabant.nl is entitled to suspend or dissolve (the execution of) the relevant agreement and any related agreements.

4.1

Triotrabant.nl will take the utmost care in taking delivery and in the execution of the order. The place of delivery is the address, which the customer has made known to the company. Subject to what is stated about this in other articles of these general terms and conditions, the company will execute accepted orders expeditiously but at the latest within 14 days.

If delivery by PostNL is delayed, or if an order cannot or can only be partially carried out, the consumer will be notified no later than one month after the order was placed. In this case, the consumer has the right to terminate the contract without charge. In case of dissolution, the amount paid by the consumer will be refunded as soon as possible, but no later than 14 days after dissolution.

5.1
Ownership of delivered products will only pass, if the customer has paid all that he owes to Triotrabant. nl under any agreement. The risk in respect of the products already passes to the customer at the time of delivery.

6.1
The customer should fully and unconditionally respect all intellectual and industrial property rights vested in the products delivered by Triotrabant. nl.

6.2
Triotrabant.nl does not guarantee that the delivered products do not infringe any (unwritten) intellectual and / or industrial property rights of third parties.

7.1
When purchasing products, you have the option of dissolving the agreement without giving reasons for 14 days. This period begins on the day after receipt of the product by or on behalf of the consumer. During this period, we ask that you handle the product and packaging with care. You shall only unpack the product to the extent necessary to assess whether you wish to keep the product. If you use the right of withdrawal, you will return the product with all delivered accessories and – if reasonably possible – in its original state to Triotrabant.nl.

7.1
You have the obligation to examine upon delivery whether the products comply with the agreement. If this is not the case, you should inform Triotrabant. nl as soon as possible and preferably within seven (7) working days after delivery, at least after observation was reasonably possible, in writing and with reasons.

7.2
In case of technical defects, such as press errors, you have the legal right to return. If this is also found in our store, you are entitled to a refund of the return shipping (please include receipt from post office!) and we will provide a new one free of charge. Please note: If the product does turn out to work, we will be forced to charge you for all shipping & handling costs incurred.

That a CD does not work because of “older” equipment is not a valid reason for return. Our advice is therefore always, to try the product on a second, younger CD/DVD player, or use a lens cleaner for the CD/DVD player first

What is old and what is new ?
A CD/DVD player older than 5 to 6 years falls under the category of “old” (the technical lifetime, with normal use, is namely +/- 5 years) and can in some cases be technically very behind the current CD/SACD/DVD technology!

8.1
If a shipment is accidentally shipped wrong and the error is caused by Triotrabant.nl, then Triotrabant. nl will take care of resending the order to the correct address – without charging extra costs.
However, if the customer provides a wrong shipping address, Triotrabant. nl accepts no responsibility for this. If the order is returned (due to a wrongly supplied shipping address), Triotrabant.nl will charge new shipping costs, or refund your order value minus the shipping costs incurred.

8.2
Where deviations from these Terms and Conditions are allowed by Triotrabant.nl for a short or longer period, tacitly or not, this does not affect its right to still demand direct and strict compliance with these Terms and Conditions. You can never assert any right on the grounds that Triotrabant. nl applies these Terms and Conditions leniently.

8.3
If one or more of the provisions of these Terms and Conditions or any other agreement with Triotrabant. nl should be in conflict with any applicable legal provision, the provision in question will cease to have effect and will be replaced by a new legally permissible comparable provision to be determined by Triotrabant.nl.

8.4
Triotrabant.nl is authorized to use third parties in the execution of your order(s).

9.1
All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law.

9.2
All disputes between the parties shall be submitted exclusively to the appropriate court in the Netherlands.
